What Is a Medical Ground of Inadmissibility?

Under INA § 212(a)(1), certain medical conditions make an applicant inadmissible — meaning USCIS cannot approve their green card application without additional action. These medical grounds of inadmissibility include: (1) communicable diseases of public health significance (such as active tuberculosis), (2) failure to present documentation of required vaccinations, and (3) physical or mental disorders with associated harmful behavior (including substance use disorders).

When the civil surgeon makes a Class A finding on Form I-693, it means one of these grounds of inadmissibility has been identified. A Class A finding does not automatically end your immigration case — but it does mean you need to take additional steps before USCIS can approve your application.

What Is Form I-601?

Form I-601, Application for Waiver of Grounds of Inadmissibility, is the form used to request a waiver of a ground of inadmissibility. For medical grounds, the waiver is authorized under INA § 212(g).

Filing Form I-601 is a formal request to USCIS to exercise its discretion and allow your application to proceed despite the inadmissibility finding. USCIS evaluates the waiver request based on the specific waiver standard that applies to your ground of inadmissibility.

The Three Medical Waiver Grounds

Who Needs a Medical Waiver?

You need a medical waiver if the civil surgeon made a Class A finding on your Form I-693. Not all medical findings require a waiver — a Class B finding (a significant departure from normal health that is not a ground of inadmissibility) does not require a waiver.
